THIS AGREEMENT is made between Capital Credits, a SEBI Registered Research Analyst (hereinafter "Research Analyst") and User (hereinafter "Subscriber").
1. SCOPE OF SERVICE: "CALLS ONLY"
The Subscriber explicitly understands and agrees that the service provided under this Agreement is strictly limited to the delivery of Research Recommendations (Trading Calls) based on technical and/or fundamental analysis.
- Informational Purpose: All calls (Buy/Sell/Hold) are for informational purposes only.
- No Execution/Management: The Research Analyst will not execute trades, manage the Subscriber’s Demat account, or provide any wealth management services and user funds.
- Final Authority: The Subscriber maintains the absolute and final authority to act, or refrain from acting, on any call provided.
- No Financial Handling & Funds Disclaimer: We strictly a research and signal provider. We do not manage, handle, or accept user funds for trading purposes.
2. ABSOLUTE EXCLUSION OF LIABILITY FOR LOSSES
The Subscriber acknowledges that trading in the Indian stock market involves significant risk, including the loss of principal capital.
- No Responsibility for Losses: Capital credits, its directors, employees, and analysts shall not be held responsible or liable for any financial losses, damages, or costs incurred by the Subscriber as a result of following or acting upon the "calls" provided.
- No Guarantee of Success: While the Research Analyst uses due diligence, there is no guarantee that the recommendations will be profitable or accurate.
- Self-Risk: The Subscriber agrees that all trades are executed at their own risk and based on their own independent judgment.
3. INDEMNIFICATION
The Subscriber agrees to indemnify, defend, and hold harmless Capital Credits and its representatives from any claims, losses, or legal expenses (including attorney fees) arising from the Subscriber's trading activities, use of research calls, or breach of this Agreement.
4. NON-REDISTRIBUTION & PROPRIETARY DATA
The Subscriber is strictly prohibited from sharing, forwarding, or reselling the research alerts in any form provided by Capital Credits. Any breach of this clause will lead to immediate termination of service without refund and may result in legal action for damages.
5. MOST IMPORTANT TERMS (MITC)
- No Profit Sharing: The Research Analyst does not engage in any profit-sharing arrangements.
- No Credentials: The Subscriber shall never share their trading passwords or OTPs with the Research Analyst. We never ask for any financial informations.
- Direct Payment: All fees must be paid directly through our mobile application payment gateway.
