The terms of service governing your use of our platform and advisory.

PLEASE READ THIS AGREEMENT CAREFULLY. BY USING THIS WEBSITE, SUBSCRIBING TO OUR RESEARCH SERVICES, OR ACTING ON OUR RECOMMENDATIONS, YOU AGREE TO BE BOUND BY ALL TERMS AND CONDITIONS LISTED HEREIN.

This Terms of Service Agreement (the "Agreement") governs your use of this Mobile application, Capital Credits (the "Website"), and the research services, trading "calls," and financial products offered by Capital credits.

I. SERVICES & REGULATORY COMPLIANCE

  1. SEBI Registration: Capital credits is a SEBI Registered [Registration No. INH0000XXXXX]. All activities are conducted in strict accordance with SEBI guidelines.
  2. Nature of "Calls": Any trading recommendations (commonly referred to as "calls") provided via our mobile application, SMS, WhatsApp are based on technical and fundamental analysis. These are model portfolios/recommendations and do not constitute "Personalized Investment Advice" unless a separate Investment Advisory Agreement is executed.
  3. No Guaranteed Returns: The Business strictly prohibits any assurance of gains or guaranteed returns. Stock market investments are subject to market risks.

II. CLIENT ONBOARDING & KYC

  1. Optional KYC: In compliance with SEBI and PMLA (Prevention of Money Laundering Act) regulations, no services will be activated until the client completes the Know Your Customer (KYC) process and Risk Profiling.
  2. Service Suspension: The Business reserves the right to hold or terminate services if KYC documents are found to be invalid, expired, or if the client’s risk profile is inconsistent with the services requested.

III. COMMUNICATIONS & SOLICITATION

  1. Consent to Reach: By registering your mobile number or email, you provide explicit consent to receive research alerts, newsletters, and promotional calls/messages from Capital Credits, overriding any DND (Do Not Disturb) registrations.
  2. Opt-Out: You may opt out of promotional communications at any time by emailing support@capitalcredits.in with the subject "Unsubscribe." However, service-related alerts will continue for the duration of your active subscription.

IV. RESEARCH SERVICES & RISK ACKNOWLEDGMENT

  1. Acknowledgment of Risk: You acknowledge that trading in equities, derivatives (F&O), and commodities involves substantial risk. Losses can exceed your initial investment.
  2. Execution Responsibility: Capital credits is not a stockbroker and does not provide execution services. The final decision to trade and the execution of those trades in your Demat account is your sole responsibility.
  3. Independent Decision Making: You confirm that you are using your own capital for trading and have not borrowed funds for the purpose of acting on our research.
  4. Anti Money Laundering: You agree not to use our services for any money laundering or illegal financial activities.

V. PROPRIETARY RIGHTS & RESTRICTIONS

  1. Intellectual Property: All research reports, "calls," and website content are the intellectual property of Capital credits.
  2. No Redistribution: You are strictly prohibited from reselling, redistributing, or sharing our research alerts in any form(screenshot, text and photograph or physical/word of mouth) with third parties. Any violation will lead to immediate termination of service without a refund and potential legal action.

VI. REFUND & CANCELLATION POLICY

  1. All Sales Final: Due to the nature of financial information and research services, all subscription fees paid to Capital credits are non-refundable and non-cancelable.
  2. Trial Period: We encourage clients to evaluate our performance through our five trading day trial before committing to a paid subscription.

VII. LIMITATION OF LIABILITY

  1. Financial Loss: Capital Credits, its directors, and employees shall not be held liable for any financial losses, damages, or costs incurred by the client resulting from the use of our research services.
  2. Technical Errors: We are not responsible for delays in delivery of "calls" due to network failures, server issues, or third-party platform (WhatsApp/SMS) outages.
  3. No Legal Action for Losses: Clients agree that any loss incurred from trades based on Capital Credits research services will not lead to legal action against the firm, its employees, or affiliates. Capital Credits provides buy, sell, or hold recommendations. They are designed for a broad audience and are not tailored to individual clients.

VIII. PRIVACY & DATA PROTECTION

  1. Data Retention: As per SEBI mandates, we maintain records of all client communications and advice for a minimum period of 5 years. We never ask for demat/ financial details from our customers. We always recommend not to share any such sensitive information, in case they reached you with our name.
  2. Data Security: Your personal data is handled in accordance with the Digital Personal Data Protection (DPDP) Act. We do not sell your data to third-party marketing firms.
  3. Data Sharing & Third-Party Disclosure: All data and services provided are for use strictly within our official app. We are not responsible for any loss, breach, or damage resulting from you sharing your account details, screenshots, or app data with third parties or on external platforms. You are solely responsible for maintaining the confidentiality of your data.

IX. DISPUTE RESOLUTION & JURISDICTION

  1. Grievance Redressal: In case of complaints, clients should first contact our Compliance Officer at grievance@capitalcredits.in. If not satisfied, you may lodge a complaint on the SEBI SCORES portal or the SMART ODR platform.
  2. Governing Law: This Website and App originate from Chennai, Tamil Nadu. This Agreement will be governed by the laws of the State of Tamil Nadu and the federal laws of India, without regard to conflict of law principles.
  3. Global Usage: This Website and App originate from Chennai, India. If you access our services from outside India, you do so at your own risk and are responsible for compliance with the laws of your local jurisdiction. However, by using our services, you expressly agree that the laws of India and the jurisdiction of Chennai shall prevail over any local laws to the maximum extent permitted. We reserve the right to limit the availability of our services to any person, geographic area, or jurisdiction at any time.

BY SUBSCRIBING TO OUR SERVICES, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, AND ARE BOUND BY THE TERMS MENTIONED ABOVE.
